Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the EkaVox platform at ekavox.app and all related services (the "Platform"). This AUP is incorporated into and forms part of our Terms of Service. By using the Platform, you agree to comply with this AUP.
EkaVox is an AI-powered development platform. Because AI tools can be powerful, we have a responsibility to ensure they are used ethically and lawfully. This policy exists to protect our users, our platform, and the broader community.
1. Permitted Uses
You may use the Platform for any lawful purpose consistent with these terms, including but not limited to:
- Building web applications, mobile applications, APIs, and other software projects for personal, educational, or commercial purposes.
- Generating, reviewing, debugging, and refactoring code using the AI-powered tools provided by the Platform.
- Exporting generated code and deploying it to your own infrastructure or app stores.
- Collaborating with team members through Organizations and shared workspaces.
- Using BYOK (Bring Your Own Key) to connect your own AI provider API keys, subject to the respective provider's terms.
- Prototyping, learning, and experimenting with AI-assisted development.
2. Prohibited Uses -- General
You may not use the Platform for any of the following purposes. This list is not exhaustive; we reserve the right to determine, in our sole discretion, whether any use violates the spirit of this policy.
2.1 Illegal Activity
- Using the Platform to develop, distribute, or facilitate any activity that violates applicable laws or regulations in any jurisdiction.
- Generating code or applications intended for fraud, identity theft, money laundering, or other financial crimes.
- Creating applications that facilitate illegal gambling, illegal drug trade, or trafficking of any kind.
2.2 Malware and Security Threats
- Generating malware, ransomware, viruses, trojans, worms, spyware, adware, or any other malicious software.
- Creating tools designed to exploit security vulnerabilities in systems you do not own or have authorization to test.
- Developing phishing pages, credential-harvesting tools, or social engineering attack kits.
- Building tools for unauthorized surveillance or data interception.
2.3 Harassment and Harmful Content
- Creating applications that promote, facilitate, or engage in harassment, bullying, intimidation, or threats of violence against any individual or group.
- Generating content or applications that promote discrimination or hatred based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
- Building applications designed to stalk, doxx, or invade the privacy of others.
2.4 Spam and Deceptive Practices
- Using the Platform to generate spam, unsolicited bulk messages, or automated content for deceptive purposes.
- Creating deepfake content, impersonation tools, or applications designed to mislead or deceive users about the origin or nature of content.
- Building applications that engage in click fraud, ad fraud, or other forms of deceptive monetization.
2.5 Platform Abuse
- Scraping, crawling, or using automated means to access the Platform except through our published APIs with proper authorization.
- Attempting to extract, reverse engineer, or replicate the behavior of the AI models accessible through the Platform (model extraction).
- Circumventing or attempting to circumvent rate limits, credit consumption mechanisms, authentication controls, or other technical restrictions.
- Sharing account credentials with others or operating multiple accounts to circumvent usage limits or abuse promotions.
- Reselling, sublicensing, or redistributing Platform access or credits without written authorization from EkaVox.
- Intentionally overloading Platform infrastructure through excessive requests, denial-of-service attacks, or similar disruptive behavior.
2.6 Intellectual Property Violations
- Using the Platform to intentionally reproduce copyrighted code, proprietary algorithms, or trade secrets belonging to third parties without proper authorization.
- Creating applications that infringe on the trademarks, patents, or other intellectual property rights of others.
- Using the Platform to circumvent digital rights management (DRM) or other technological protection measures.
3. AI-Specific Rules
Given the AI-powered nature of the Platform, the following additional rules apply specifically to how you interact with and use AI generation features:
3.1 Absolutely Prohibited AI Uses
The following uses of the Platform's AI features are strictly prohibited without exception:
- Child Sexual Abuse Material (CSAM): Generating, attempting to generate, or using the Platform to facilitate the creation of any content that sexually exploits or endangers minors. This includes code for platforms that host, share, or distribute such material. Violations will be reported to the relevant law enforcement authorities immediately.
- Weapons of Mass Destruction: Generating code, instructions, or applications related to the design, manufacture, or deployment of chemical, biological, radiological, or nuclear weapons or explosive devices.
- Terrorism and Violent Extremism: Creating applications or content that recruit for, promote, or provide material support to terrorist organizations or violent extremist movements.
3.2 AI Uses Requiring Disclaimers
The following uses of AI-generated code are permitted only with appropriate disclaimers and safeguards:
- Medical Applications: If you use the Platform to build applications that provide health-related information, symptom checkers, or wellness tools, you must include prominent disclaimers stating that the application does not provide medical advice, diagnosis, or treatment, and that users should consult a qualified healthcare professional. You must not represent AI-generated medical information as professional medical advice.
- Legal Applications: If you use the Platform to build applications that provide legal information or document generation, you must include prominent disclaimers stating that the application does not provide legal advice and that users should consult a qualified attorney. You must not represent AI-generated legal content as professional legal counsel.
- Financial Applications: If you use the Platform to build applications that provide financial information, investment analysis, or trading tools, you must include prominent disclaimers stating that the information is not financial advice and that users should consult a qualified financial advisor.
- AI-Generated Content Disclosure: If you build applications that present AI-generated text, images, or other content to end users, you should disclose that the content is AI-generated, particularly in contexts where users might reasonably expect human-created content.
3.3 Responsible AI Use
- You are responsible for reviewing all AI-generated code before deploying it, particularly for security vulnerabilities, data privacy issues, and compliance with applicable regulations.
- You must not use the Platform to build applications that make automated decisions with significant legal or life-altering consequences (such as credit scoring, criminal sentencing, or employment decisions) without appropriate human oversight and appeal mechanisms.
- You must not attempt to use prompt injection, jailbreaking, or similar techniques to bypass the safety filters of the AI models accessible through the Platform.
- You must not use the Platform to generate synthetic training data for the purpose of training competing AI models.
4. Consequences of Violations
Violations of this Acceptable Use Policy may result in one or more of the following actions, at our sole discretion and depending on the severity of the violation:
4.1 Warning
For first-time or minor violations, we may issue a written warning via email, explaining the violation and requesting corrective action. You will be given a reasonable period (typically 48 hours) to remediate the violation.
4.2 Temporary Suspension
For repeated or more serious violations, we may temporarily suspend your access to the Platform. During suspension, you will not be able to use AI features, export code, or access your projects. Suspension periods are determined on a case-by-case basis and typically range from 7 to 30 days.
4.3 Permanent Termination
For severe violations, repeated violations after warnings, or violations of the absolutely prohibited uses described in Section 3.1, we may permanently terminate your account. Upon permanent termination:
- Your access to the Platform is revoked immediately and permanently.
- All unused credits, including purchased credits, are forfeited and non-refundable.
- Your project data may be deleted after a 30-day retention period, during which you may request an export of your data (excluding any content that violates this policy or applicable law).
- You may be prohibited from creating new accounts on the Platform.
4.4 Credit Forfeiture
In cases of account suspension or termination due to policy violations, all credits associated with the account (including purchased credits, subscription credits, and promotional credits) are forfeited. No refund will be issued for forfeited credits.
4.5 Legal Action
EkaVox reserves the right to pursue legal action against users who engage in activities that cause harm to EkaVox, its users, or third parties, or that violate applicable law. We will cooperate with law enforcement authorities when required by law or when we believe it is necessary to protect public safety.
5. Reporting Violations
If you become aware of any use of the Platform that violates this Acceptable Use Policy, we encourage you to report it. You can report violations by:
- Sending an email to legal@ekavox.app with the subject line "AUP Violation Report".
- Including as much detail as possible, such as the nature of the violation, any relevant URLs or project identifiers, and screenshots if applicable.
We take all reports seriously and will investigate in a timely manner. Reports are treated confidentially, and we will not disclose the identity of the reporter to the accused party unless required by law.
6. Monitoring and Enforcement
EkaVox reserves the right, but is not obligated, to monitor use of the Platform for compliance with this AUP. We may use automated tools and manual review to detect potential violations. However, we do not proactively review the content of all projects or AI-generated outputs.
Additionally, the third-party AI providers (Anthropic, Google, OpenAI) apply their own content moderation and safety policies to API requests. These providers may independently refuse to process certain requests or flag content for review. EkaVox is not responsible for the enforcement actions taken by third-party AI providers.
7. Appeals
If you believe that enforcement action has been taken against your account in error, you may appeal by sending an email to legal@ekavox.app with the subject line "AUP Appeal". Include your account email address, a description of the enforcement action, and a detailed explanation of why you believe the action was taken in error.
We will review appeals within 10 business days and notify you of our decision. The decision on appeal is final. During the appeal process, the enforcement action remains in effect.
8. Changes to This Policy
We may update this Acceptable Use Policy from time to time to reflect changes in our services, legal requirements, or industry best practices. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised policy.
